Please note you must read the terms and conditions, sign and return this form to Newsquest Oxfordshire prior to an order being processed.

Contract entered into by Newsquest Oxfordshire (“the Company”) shall be entered into subject to the following conditions:

Content

The placing of an order for distribution constitutes an assurance by the Client that;

  • The material to be distributed (the leaflet) does not contain anything which is dangerous, constitutes an infringement of copyright, or is defamatory, obscene or otherwise illegal.
  • All necessary authority and permission has been secured in respect of the use in the leaflet of pictorial representations of (or purporting to be of) living persons and of words attributed to living persons.

Copy shall be legal, decent, honest and truthful, shall comply with the British Code of Advertising Practice or British Code of Sales Promotion Practice and all other codes under the general supervision of the Advertising Standards Authority.

The Company reserves the right to require copy to be amended to meet its approval and to omit or suspend the distribution of any leaflet at its sole discretion.

Leaflets submitted for distribution must bear an imprint if such is required. – The client agrees to indemnify the Company in respect of all costs, damages or other charges falling upon the Company as the result of legal action or threatened legal action arising from the publication and/or distribution of the leaflet.

Supplies

Material for distribution shall be delivered to the Company’s specified delivered address not earlier than 2 weeks, nor later than one week prior to the commencement of the distribution. Deliveries should be made between Monday – Thursday 9am –5pm and Friday 9am – 12 noon. The Company reserves the right to make an additional charge of £10 per 1000 in respect of material supplied to the Company after the deadline or refuse to deliver such material, at its absolute discretion.

In the event of material being different in terms of size, weight or shape to that specified on the Company’s order form the Company reserves the right to make an additional charge or to refuse to deliver such material, at its absolute discretion.

Leaflets must be securely packed in regular quantities and clearly marked as such. The Company reserves the right to make an additional charge of £1 per 1000 for leaflets incorrectly packed or to refuse to deliver such material, at its absolute discretion.

The Company is under no obligation to check the quantity of material supplied for distribution nor accept the accuracy of any information shown on any delivery notes of the Client or the Client’s delivery agent, but will so far as reasonably possible notify the Client if the amount of material falls short or exceeds the requirements of the agreed distribution.

No liability is accepted for Client’s material whilst in the Company possession.

Cancellation and Alterations

Cancellations must be notified in writing to the Company sever working days prior to the distribution date. Cancellations for orders not so notified will be charged at a rate of 50% of the value of the original order.

Distribution

Unless otherwise stated, distribution will normally take place within the specified publication, to the individual addresses, which usually receive that publication within the area and on the date(s) scheduled. This does not necessary imply 100% penetration of all addresses within the area.

Whilst every effort will be made to meet the agreed schedule and this will always apply to dated material the Company reserves the right to vary both the method and timing of the distribution. This will be done in conjunction with the Client.

The stated distribution objectives and overall quantity distributed are subject to a variance of upto 2% within the terms of contract. Distribution is undertaken on a contract price – not a payment by results basis.

Distribution Queries

The Company will not be responsible for the production costs of leaflets or loss of business or any other loss or damage howsoever arising occasioned by non-delivery or delay in distribution of leaflets for whatever reason, save as stated in the clause below.

Evidence of non-delivery, in the form of specific addresses of those who have not received the material in the agreed area must be furnished to the Company with 5 working days of the distribution date. If the evidence proves there has been a total or partial failure of delivery in the agreed area the Company shall deliver the material to those addresses free or charge or refund the proportional cost of delivery to the Client but shall not incur any other liability whatsoever to the Client.

Payment

Unless a credit account is agreed, payment must be received at the time of booking.

Credit accounts are strictly net and must be settled within 25 days of date of Statement or interest will be charged at 3% above the Midland Bank base rate. Cheques, postal orders and money orders should be crossed and made payable to Newsquest Oxfordshire. Credit accounts are at the sole discretion of the Company and may be withdrawn at any time.

The Company will be entitled to charge the amount of any Value Added Tax payable whether or not stated in the contract or included in the quotation.

General

Unless otherwise stated, the price quoted applies only to the distribution of leaflets on behalf of individual advertisers and/or businesses who are promoting their own goods, services, functions, etc via material specifically printed on their behalf.

The placing of an order for distribution shall amount to an acceptance of the above conditions and any conditions stipulated on the Client’s own order form or elsewhere by the Client shall be void insofar as they are in conflict with them.

Newsquest Oxfordshire – Leaflet Delivery Specifications

In order to ensure the safe and correct delivery of goods to Newsquest Oxfordshire, the following guidelines must be adhered to:

  • Boxes must be clearly labelled with the following information:
  • Title of insert or sample attached to outside of the box.
  • Marked for the attention of either Claire Kiernan or Henrietta Collins
  • Publication & date to be inserted
  • Quantity of inserts/boxes
  • Inserts must be flat packed with tight folds, no distortions or any curled edges.
  • Minimum insert size is A5 and paper weight of 115gsm.
  • Inserts must be stacked in large bundle quantities, no more than two turns per box .
    • If inserts are not suitable for packaging in cartons they must be supplied in budles containing a sufficient quantity to measure 80mm (+/-10mm) in height where applicable all spines MUST face the same direction. They bundles MUST NOT contain turns and wherever possible must only have a single strap across the shortest dimension. Individually shrink-wrapped bundles are NOT acceptable as the inserting process does not allow time for unwrapping.
  • A Delivery Note must be submitted with the delivery including the following information:
    • Title of insert
    • Number of inserts
    • Number of boxes
    • Date of delivery
    • For whom the delivery is for
    • Name of person who has delivered the inserts to NQO.
    • A sample must be attached to the delivery note.
  • Deliveries must be accepted by a representative from Newsquest Oxfordshire (NQO), on no account must any deliveries be left unchecked. NQO will not be held responsible for loss or damage of any leaflets if they were NOT accepted or checked by a representative of Newsquest Oxfordshire.
  • All inserts must be delivered to the ‘Dispatch’ area of Newsquest Oxfordshire.
  • Deliveries to be made between Monday-Thursday from 9am-5pm
  • Deliveries must arrive at Newsquest Oxfordshire Thursday noon one week prior to insertion.
  • Newsquest Oxfordshire cannot be held responsible for failure to include inserts that arrive beyond the stated deadlines.
  • An additional handling charge may be applied if inserts have to be repacked to make them acceptable for production, if this is the case the Client will be notified prior to the commencement of work, however any delays caused by re-packing may result in an overall delay in distribution.
Inserts that do not conform to the above specifications may be rejected if not suitable for mechanical insertion.
